Memorandum of Understanding on Cooperation between the National Communications Authority, Hungary (NCAH) and Autoridade Nacional de Comunicações (ANACOM)

The Parties, as national regulatory authorities of their respective countries, Expressing their readiness to maintain regular contacts and to develop practical cooperation on matters relating to communications services and regulations, Considering that the development and promotion of the communications sector is an essential factor in the economic development and social welfare of the populations of the two countries and that issues of mutual interest and concern exist in this area, have agreed as follows:

1. The Parties shall exchange, on a regular basis, information concerning the development of policies and strategies on communications in their countries, taking into account the developments at European Union level and their implementation in terms of national legislations and regulatory activities. They shall exchange in particular, views and experiences on the incorporation of relevant EU directives into their respective national regulatory systems.

2. The Parties shall also exchange, on a regular basis, information on their national communications laws and regulations, including any amendment or modification thereof.

3. The Parties shall exchange all publicly available data on their activities and national communications markets. The data provided shall be updated on an annual basis.

4. Expert level delegations may be exchanged annually for the study of the technical, legal and other aspects of national regulatory activities. The detailed agenda, and the resources involved, of the exchange program shall be tentatively agreed upon by the end of the previous year.

5. The Parties shall, where appropriate, inform, and extend invitations to, each other on international symposia and conferences organized under their auspices.

6. The Parties may promote participation of their staff members in the training programs of the other Party.

7. High level officials of the Parties shall meet annually for consultations to review the implementation of the present Memorandum, to set the priorities for cooperation within its framework for the next term, and to exchange views and take, where appropriate, joint actions or positions at European and other international fora and organizations related to the communications sector.

8. The present Memorandum shall enter into force on the date of its signature and shall remain valid for a period of 2 (two) years. It shall be automatically prolonged unless one of the Parties decides not to renew it.

9. This Memorandum may be amended by mutual agreement between the Parties.
