On 19 July 2023, ANACOM approved the draft amendment to Regulation No 1165/2022https://www.anacom.pt/render.jsp?contentId=1735066 of 14 December, which defines the methodology for calculating the net costs of the universal service obligation related to the application of the social tariff for the provision of broadband Internet access services (SIT).
Currently, article 5 of this Regulation establishes a transitional period for companies that wish to do so to submit an application for compensation for the unfair burden of providing the social tariff for the provision of broadband internet access services (SIT) during 2022 until the end of January 2023, in compliance with paragraph 2 of article 157 of the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=1737530 (ECL).
With the amendment proposed in the draft amendment, article 5 will now provide a final deadline for the submission of applications for compensation for unfair burden, establishing that such applications must be submitted by providers by the end of January of the year following that to which the costs to be compensated relate.
The draft regulation will be published in Series II of the Official Gazette, with a period of 30 working days from that date for contributions to be submitted, in writing and in Portuguese, preferably by e-mail to altreg11652022@anacom.ptmailto:altreg11652022@anacom.pt.
