Wholesale markets for call termination on public telephone networks at a fixed location - notification to European Commission


By decision of 19 July 2018, ANACOM has approved draft decisions to be notified to the European Commission (EC), the Body of European Regulators of Electronic Communications (BEREC) and the national regulatory authorities (NRA) of the other Member States of the European Union (EU) – these draft decisions are with regard to the wholesale markets for call termination on public telephone networks at a fixed location, covering:

  • the definition of the relevant market; assessment of significant market power (SMP) and imposition, maintenance, amendment or withdrawal of regulatory obligations;
  • the specification of price control obligations.

Following the analysis, ANACOM considers that, in Portugal, the wholesale markets for voice call termination on the public telephone network at a fixed location are of a dimension which corresponds to the network of the provider that makes the service available. ANACOM also considers that these markets correspond to the termination of calls at a fixed location on each of the individual networks, when applicable at local and single transit levels, and regardless of the transport technology and interconnection interface used.

ANACOM likewise considers that all providers providing the voice call termination service on individual public telephone networks at a fixed location have SMP in this market - this group of providers includes all those with geographical and nomadic numbering resources (30 numbering range).

The obligations to be imposed on SMP providers in these markets during the period of this analysis's validity comprise the obligation to control prices (the maximum termination price that operators can employ is determined based on the results of the "pure" LRIC costing model developed for this purpose). The maximum termination price for voice calls on fixed networks to be applied by fixed operators notified with SMP, applicable 10 days following adoption of the final decision, is fixed at 0.047 eurocents per minute (billing per second from the first second).
