Universal service of electronic communications - compensation fund and net costs


By decision of 19 December 2014, ANACOM has approved a draft decision listing the undertakings required to contribute to the electronic communications universal service compensation fund and setting the value of the extraordinary contributions, in respect of the CLSU - custos líquidos do serviço universal (net costs of universal service) to be compensated for the period prior to the designation, by tender, of the universal service provider for the years 2007-2009.

This decision stems from the provisions of the LCE - Lei das Comunicações Eletrónicas (Electronic Communications Law) and Law no. 35/2012 of 23 August, which set up the compensation fund to finance the net costs of universal service provision and set the criteria to apply in allocating these costs among the undertakings providing electronic communications networks or publicly available electronic communications services.

ICP-ANACOM determines:

  • a review, in particular following auditing and analysis conducted by ANACOM, of the eligible turnover values of certain companies reported for purposes of calculating the overall turnover of the sector;
  • the value of the sector's overall eligible turnover (4,688,825,892.06 euros), for the purposes of Law no. 35/2012;
  • the list of undertakings required to make the payment of an extraordinary contribution to the compensation fund and the value of each undertaking's contribution, whereas the total corresponds to the value of compensation payable to PT Comunicações (PTC), as universal service provider, in respect of the net cost for the years 2007-2009, as approved by ANACOM on 19 September 2013;
  • a time limit of 20 working days, following notification of the final decision, for payment of the contributions identified in the previous paragraph.

It was also decided to submit this draft decision to the prior hearing of interested parties for a period of 10 working days under the terms of the Código do Procedimento Administrativo (Administrative Proceeding Code).
