Assessment of mobile electronic communications market - Final Decision


By determination of 28 August 2014, ANACOM has approved a decision on the assessment of the mobile electronic communications market, pursuant to article 39 of the Multiband Auction Regulation (Regulation no. 560-A/2001 of 19 October).

ANACOM considers that, since there is no need to remedy imbalances resulting from the allocation of spectrum, there is nothing, at present, as would warrant regulatory intervention pursuant, in particular, to the powers conferred upon ANACOM by articles 20 and 35 of the Lei das Comunicações Eletrónicas (Law Electronic Communications - Law no. 5/2004 of 10 February, as amended and republished by Law no. 51/2011 of 13 September, and as subsequently amended).

ANACOM also pointed out that, under the Lei das Comunicações Eletrónicas (Electronic Communications Law), it has the option of evaluating efficient use of spectrum by mobile operators and the effectiveness of the network access obligations imposed on them, and that it will only become fully effective with the end of current restrictions on operation in the 800 MHz band, noting that future European decisions on spectrum will also impact analyses carried out by the regulator.

On the same date, ANACOM also approved the report on the prior hearing and consultation to which the respective draft decision was submitted, following determination of 15 May 2014.
