Final decision on use of the term 'unlimited' to describe offers of electronic communications services


By determination of 19 June 2014, ANACOM has approved the final decision on use of the term "unlimited" to refer to offers of electronic communications services.

This decision maintains the essence of the draft decision submitted to consultation, whereby providers of electronic communications services:

  • may not use the term "unlimited traffic" or "unlimited calls/SMS" to describe offers of electronic communications services, except where such offers are effectively made available "without limits" and "without restrictions" throughout the duration of the contract;
  • shall make clear and transparent information available, in the respective terms and conditions governing offers, as to any restrictive measures or constraints which may, on an exceptional basis and in accordance with the terms of the present determination, be applied to internet traffic;
  • shall make explicit reference, in the terms and conditions governing offers described as unlimited, as to the exceptional nature of any restrictive measures or constraints on traffic.


It was further decided to establish a period of 90 calendar days, from the date on which the determination is notified, so that undertakings providing public communications networks and electronic communications services may implement the measures necessary to comply with the determination.
