Unbundled access and broadband access wholesale markets - public consultation


ANACOM launches today, for a period of 30 working days, two public consultations, one related to the unbundled access wholesale market (market 11) and another one related to the broadband access wholesale market (market 12). The aim is to define and study competition in these markets, declaring the companies with significant market power (SMP) and determining the appropriate regulatory obligations (‘remedies’).  These consultations, which integrate the corresponding ANACOM draft decisions, were approved by determinations of yesterday, 24 November.

Definition of these markets and analysis of the competition in the same were already subject to a preliminary public consultation (integrated in the 2nd phasehttps://www.anacom.pt/render.jsp?categoryId=79670), launched on 23 September 2003, available in this site, together with the received contributions. In November 2003, the companies acting in those markets were requested to provide the necessary quantitative information to this process, through a questionnairehttps://www.anacom.pt/render.jsp?contentId=420952 launched to this purpose.

The Competition Authority was notified to provide an advice under the terms of article 61 of Law no. 5/2004, of 10 February. Furthermore, the specific consultation procedure on the draft decisions now approved to the European Commission and to the national regulatory authorities (NRA) of the remaining Member-states was also initiated.
