Extension of deadline - telephone directories and information services within the scope of the universal service


ANACOM has established a new deadline, which shall expire on 14 September 2007, in order to allow Optimus - Telecomunicações  and PT Comunicações (PTC) and Vodafone Portugal - Comunicações Pessoais and PTC to pursue negotiations to conclude an agreement, pursuant to and for the purposes of article 89 of the Electronic Communications Law (Law no. 5/2004, of 10 February), on the format and conditions governing the supply of relevant information on the respective subscribers who have made a favourable indication as to the inclusion of their personal data in telephone directories and information services within the universal service.

On 24 May 2007, ANACOM established a 30-day deadline so that the referred companies took steps to reach an agreement. The three companies notified this Authority that this agreement has not yet been reached, identifying convergence and divergence points in the course of negotiations, stating that issues of a technical and financial nature remained to be discussed.

Notwithstanding the fact that no agreement has been reached so far, companies have undertaken a number of steps to this end, and bearing in mind that it is desirable and convenient that operators themselves set the format and conditions governing the supply of relevant information on the respective subscribers who have made a favourable indication as to the inclusion of their personal data in telephone directories and information services within the universal service, ANACOM takes the view that companies should pursue further negotiations to enable the conclusion of agreements.

This decision has determined likewise that, upon expiry of the established deadline, the referred companies must submit to ICP-ANACOM copies of any agreements concluded and, in case the companies do not reach the referred agreement, they must inform this Authority of the fact, describing in detail all steps taken, difficulties encountered and ways which may likely solve them, providing the respective evidence, so that ICP-ANACOM may determine the format and conditions for the provision of this information to the universal service provider.
