21.2. National cooperation


21.2.1. AdC - Autoridade da Concorrência (Competition Authority)

In 2012, as in previous years, AdC sought contribution on a number of issues:

  • An opinion on call origination pricing for special services and non-geographic numbers on national mobile networks, sent in December 2012 (this issue is detailed in section 22.1 Implementation of measures set out in the Memorandum of Understanding).
     
  • An opinion issued on 12 July as part of an investigation into possible administrative offences following a complaint presented by Iberomail - Correio Internacional, S.A. against CTT for alleged abuse of dominant position.
     
  • An opinion sent on 10 September, on the notification of the acquisition by Altice Portugal, S.A. of sole control of Cabovisão. In October, AdC presented a new request for an opinion on the acquisition of control of Cabovisão, under the same rules. The new request for an opinion stemmed from a new notification, referring not to the acquisition of sole control of Cabovisão by Altice, but joint control of Cabovisão by Altice VII S.à.r.l and by Codilink S.à.r.l., through Altice. The requested opinion was issued on 9 November 2012.

21.2.2. Assembly of the Republic

In 2012, ICP-ANACOM produced several specific opinions and appeared before parliamentary hearings upon request of the Assembleia da República (Assembly of the Republic) in the context of its working groups and parliamentary committees.

In this context, note is made of the parliamentary hearing held on the draft law transposing the Postal Directive - Draft Law 35/XII/1 (GOV) - which took place on 7 February at the request of the Working Group on the liberalisation of postal services, established by the Parliamentary Committee on Economics and Public Works. Following this hearing, and at the request of this working group, ICP-ANACOM issued an opinion on the proposal in question.

Note is also made of the opinion prepared by ICP-ANACOM on Draft Law no. 98/XII (GOV) amending Law no. 23/96 of 26 July (Lei dos Serviços Públicos Essenciais - Essential Public Services Law), Law no. 24/96 of 31 July (legal regime governing consumer protection), and the ECL, upon request of the Parliamentary Committee on Economics and Public Works (Assembly of the Republic).

21.2.3. IPQ - Instituto Português da Qualidade (Portuguese Institute of Quality)

Activity of Sector Standardisation Body (ONS)/ICP-ANACOM during 2012

In 2012, the activity developed within the ONS/ICP-ANACOM for telecommunications, postal activity and electromagnetic compatibility, comprised analysis of about 320 documents, distributed by theme as according to the following graph:
