In preparing the telecommunications sector for liberalisation of the fixed telephone service as from 1 January 2000, the Portuguese Communications Institute (ICP) launched a public consultation process to gauge interest in the use of fixed radio access.

This measure, adopted in recognition of the importance of fixed radio access for the supply of new telecommunications services, aims to promote new services and technological platforms.

Of vital importance in the allocation of frequencies for FWA is the establishment of a special tariff system governing use of the public radio domain which encourages and promotes its correct and efficient use.

Thus:

Through the Minister of Equipment, Planning and Territorial Administration, under the terms of paragraph 1 of article 9 of Decree-Law nr. 207/92, of 2 October, the Government hereby orders the following:

1. The use of each range of frequencies allocated for fixed radio access shall be subject to the payment of the annual charges shown in the following table:

Zone A: includes the districts in the following units of level 3 of the Nomenclature of Territorial Units for Statistical Purposes (NUTS), established by Decree-Law nr. 46/89, of 15 February, in the wording given by Decree-Law nr. 163/99, of 13 May:

Minho-Lima;
Cávado;
AVO;
Tâmega;
Entre Douro e Vouga;
Douro;
Upper Trás-os-Montes;
North Inland Pinhal;
South Inland Pinhal;
Dão-Lafões;
Lower Alentejo;
Autonomous Region of the Azores;
Autonomous Region of Madeira.

Zone B: includes the districts in the following units of level 3 of the Nomenclature of Territorial Units for Statistical Purposes (NUTS), established by Decree-Law nr. 46/89, of 15 February, in the wording given by Decree-Law nr. 163/99, of 13 May:

Lower Vouga;
Lower Mondego;
Coastal Pinhal;
Serra da Estrela;
North Inland Beira;
South Inland Beira;
Cova da Beira;
West;
Central Tejo;
Lezíria do Tejo;
Coastal Alentejo;
Upper Alentejo;
Central Alentejo.

2. The annual charges set under the terms of the previous paragraph shall be paid in January of the year to which they refer unless another date is set by the Portuguese Communications Institute (ICP).

3. If the allocation of frequencies commences during a calendar year, the annual charge shall correspond to one twelfth of the standard annual charge for each month left in the same calendar year, a part of a month considered a complete month.

4. The charges referred to in paragraph 1 may be reviewed within two years.

5. Entities licensed to use frequencies for fixed radio access shall also be subject to the payment of the other charges prescribed for public radio use - mobile terrestrial service - contained in the radio services tariff, under the terms of Decree-Law nr. 207/92, of 2 October.
