By determination of 15 April 2009, ANACOM has decided to launch a public consultation on the draft regulation amending Regulation no. 58/2005, published on 18 August (Portability Regulation) and as amended by Regulation no. 87/2009, published on 18 February.
Pursuant to Regulation no. 87/2009 (article 4, paragraph 2), Annexes I and II to the Portability Specifications were reviewed and updated by companies with portability obligations and by the Reference Entity, in coordination with ANACOM. The amendment to the Specifications was approved, under the terms of the same determination of 15 April.
However, questions have arisen as a result of this process with respect to the means of calculating the time limits set out in certain provisions of the Regulations, specifically with respect to their compatibility with the corresponding time limits set out in the Portability Specifications. Consequently, ANACOM decided to again amend the Regulation with the sole purpose of making it clear that the time limits set out therein are equivalent to those set out in the Specifications.
This draft amendment is subject to the regulatory procedure established in Article 11 of ANACOM's Statutes, as well as the general consultation procedure established in Article 8 of the Law of Electronic Communications, with a period of 30 working days provided for interested parties to submit their comments under both procedures. Comments should therefore be received by 2 June 2009, preferably sent by e-mail to "regportabilidade@anacom.pt".
Once the consultation process has been concluded, the responses received will be published on this website, whereby interested parties should clearly indicate any items which they consider confidential.
