Council of Ministers address electronic communications infrastructure


The Council of Ministers has today given approval to the Decree-Law which defines the legal regime governing the construction, access and installation of networks and infrastructure of electronic communications. The aim of this legislation is to remove or mitigate barriers to the construction of infrastructure designed to house electronic communication networks, promoting the development of next generation networks. Furthermore, according to the communication now released, a centralised information system (CIS) will be set up on infrastructure records and the legal regime will be defined to apply to telecommunications infrastructure in housing estates, developments and condominiums (ITUR), in addition to the alteration of the ITED regime (telecommunications infrastructure in buildings).

With the objective of complementing and strengthening the provisions of this Decree-Law, approval was likewise given to a draft law which authorises the Government to legislate on the regime of open access to infrastructure suited for the housing of electronic communication networks, municipal fees charged for the use of the public or local authority private domain and the alteration of the regime governing appeals of ANACOM's acts, as provided for in Law 5/2004 of 10 February.
