Applications for the 5th TV channel excluded


The Regulatory Board of Regulatory Authority for the Media (ERC) decided on 19 February 2009, to exclude the two applications submitted under the public tender for the licensing of a generalist programme service on a national basis with free unrestricted access. The applications were excluded because they failed to meet the legal and regulatory requirements for admission to the tender.

According to the reasoned proposal on the list of admitted and excluded applications, «(...) the Council considers that, with respect to ''the viability of the Economic-Financial Plan and its conformity with the requirements set out in the Tender Specifications'', the proposal of Telecinco manifestly fails to fulfil this condition of admission to the competition». The application of Zon II has already been excluded because «with respect to sufficient human resources being allocated to the project, it is manifest that this minimum does not reach levels which, in this aspect and reasonableness, fulfil the requirements for admission to the tender now under examination».

The tenderers now have the opportunity to express their position with respect to this draft decision in a prior hearing of the parties under Articles 100 et seq. of the Code of Administrative Procedure.
