New groups in the framework of the 1999 Communications Review

The European Commission has established the Radio Spectrum Policy Group and the European Regulators Group for Electronic Communications Networks and Services through Decisions 2002/622/EC and 2002/627/EC of 26 and 29 July 2002, respectively. These Decisions follow the approval of the 1999 Communications Review Package, published last April, which has issued a new and harmonized regulatory framework for the electronic communications sector.

On the one hand, the Radio Spectrum Policy Group concerns directly Decision No 676/2002/EC of the European Parliament and of the Council, of 7 March 2002 (Radio Spectrum Decision) on a regulatory framework for radio spectrum policy in the European Community, notwithstanding the fact that its work should not interfere with the work of the Radio Spectrum Committee.

 The Radio Spectrum Policy Group shall assist and advise the Commission on radio spectrum policy issues, making sure it takes into account not only technical parameters but also economic, political, cultural, strategic, social and health considerations, as well as the needs of users. The Group shall gather high-level governmental experts from the Member States and a representative of the Commission and shall consult extensively and in a forward-looking manner on technological, market and regulatory developments.

The European Parliament, the European Conference of Postal and Telecommunications Administrations (CEPT), the European Telecommunications Standards Institute (ETSI), as well as representatives from the European Economic Area States (EEA) and those States that are candidates for accession to the European Union may participate as observers in the Group.

On the other hand, the European Regulators Group for Electronic Communications Networks and Services shall be a body for reflection, debate and advice to the Commission in the electronic communications field, in such a way as to contribute to the development of the networks and services internal market, operating as a privileged interface between national regulatory authorities and the Commission. The Group will comprise the head(s) of each national regulatory authority responsible for overseeing the interpretation and application of the provisions of the new regulatory package.

This Group shall submit an annual report of its activities to the Commission, maintaining close cooperation  with the Communications Committee (COMCO) established under the Framework Directive (European Parliament and Council Directive 2002/21/EC of 7 March 2002, on a common regulatory framework for electronic communications networks and services), as well as with the Radio Spectrum Policy Group and the Television Without Frontiers Contact Committee (created pursuant to Directive 97/36/EC of the European Parliament and of the Council on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of television broadcasting activities).

Representatives from EEA States and from those states that are candidates for accession to the European Union may participate as observers in the Group.
