Determination of ANACOM on the alteration of the conditions for the Shared Access Offer
Having regard to the need to promote an economically effective solution and to simplify the process regarding the shared access, the Board of Administration of ANACOM approved, by deliberation of 19 June 2003, the likely purport of the determination on the alteration of the conditions for the shared access offer, which was notified to interested parties, who, pursuant to articles 100 and 101 of the Code of Administrative Procedure, were entitled to assess the issue within 10 working days at the most.
Within the scope of the prior hearing, comments were received from Novis Telecom, S.A., OniTelecom, and PT Comunicações, S.A. The comments received, the respective analysis and the reasoning of ANACOM?s decision are comprised in the ?prior hearing report granted to interested parties on the likely purport of the decision regarding the alteration of the conditions for the shared access offer?, annexed to this determination.
Therefore, the Board of Administration of ANACOM hereby determines, pursuant to point a) of paragraph 2 and to paragraph 3 of article 4 of the Regulation (EC) No. 2887/2000 of the European Parliament and of the Council, that PT Comunicações shall amend the RUO within a 15-day time limit, having regard to the following:
1. The installation, operation and maintenance of the exchange splitter is incumbent upon the OLO beneficiaries. The splitter may be integrated in the DSLAM.
2. PT Comunicações shall connect, through an internal or external tie cable, the intermediate Distribution Frame to the Handover Distribution Frame (HDF), as well as the return from the Handover Distribution Frame to the intermediate Distribution Frame.
3. PTC shall amend the shared loop request form, whereby it shall be incumbent upon the OLO to indicate two HDF positions per shared access, each position bearing an appropriate designation.
4. A swift process of information exchange shall be established between PTC and the beneficiary for the prompt resolution of the faults at the switch splitter level, affecting the fixed telephone service.
