General and Prior Conditions to the Negotiation of Interconnection Agreements

The detailed definition and publication of the general and prior conditions to the negotiation of interconnection agreements which are mandatory under the terms of no. 1 of article 14 of Decree-Law no. 415/98 dated December 31st, is shown below. These obligations are applicable to entities discriminated in article 11 of Decree Law no. 415/98.

Under the terms of no. 4 of article 14 of the said diploma, the Instituto das Comunicações de Portugal shall motivate or, when justified, determine case by case, the inclusion of certain subjects in the interconnection agreements to be celebrated between the entities referred to in the above-mentioned article 11.

In this context the ICP decided it was necessary to define and publish the general and prior conditions to the negotiation of interconnection agreements to be celebrated in the current year in 1999, taking into account the real market conditions in Portugal at the date of publication.

Considering that the closeness of the date for the total liberalisation of the sector may eventually imply the consideration of additional requirements caused by the said liberalisation, the Instituto das Comunicações de Portugal made a fresh evaluation of the general and prior conditions, attending at the same time the earlier consultation of the interested entities when it was concluded that it would not be appropriate to add further requirements to the general and prior conditions to the negotiation of interconnection agreements beyond those conditions already published in 1999 and which suffered minimal changes.

Therefore the Instituto das Comunicações de Portugal hereby proceeds with the publication of the general and prior conditions to the negotiation of interconnection agreements applicable in the year 2000.
