With regard to Portugal, the 10th report highlights the transposition of the regulatory package on electronic communications into internal law on 10 February 2004.

Analysis of the national market allows us to conclude that competition has had a relatively limited effect on both market development, where the report emphasises that the incumbent is still dominant in most markets, and on infrastructure. The mobile sector warrants special mention on account of the high level of penetration (about 90% of the population).  Reference is made to the increased price of calls announced by the three mobile operators which may indicate a change in the level of competition.

In relation to ANACOM, it is emphasised that the regulator?s independence is clearly defined in legislation and that cooperation with the Anti-Trust Authority is still in an initial phase.  In addition, the report refers to the main aspects of ANACOM?s work, giving special mention to the measures adopted in several areas (access and interconnection, unbundling of the local loop, leased lines, and others), the analysis processes of the different markets, general authorisation and the overall service.
