By determination of 17 July 2004, the public consultation report on the offer for access to PT Comunicações, S.A. (PTC) concessionaire ducts was approved, launched on 29 April 2004, under the terms of paragraph no. 4 of article 26, of Law no. 5/2004, of 10 February, and of article 9 of ICP-ANACOM Statutes, which presents a summary of the seven received replies (from PT Comunicações SA, from Associação dos Operadores de Telecomunicações, from OniTelecom ? Infocomunicações, S.A., from Novis Telecom, S.A., from Vodafone Portugal, Comunicações Pessoais, S.A., from Tvtel Grande Porto - Comunicações, S.A. and from Autoridade da Concorrência) and of the understanding of this Authority on the raised questions.
It was also simultaneously approved the decision on the offer for access to the concessionaire ducts, after hearing PT Comunicações (PTC) under the terms of Article 100 and following ones of the Rules of the Administrative Procedure and the remaining interested entities according to Article 8 of the above-mentioned Law no. 5/2004.
The concessionaire should, namely, make available, upon request of the beneficiary entities, access and use of ducts and visit boxes that are its property or which management is its responsibility, complying with the principles of transparency, non-discrimination and cost orientation. In addition, PTC should submit every year to ICP-ANACOM a reference offer for use and access to the ducts and associated infrastructure that are its property or which management is its responsibility, complying with the principles of transparency, non-discrimination and cost orientation, fulfilling the hereby approved minimum elements.
