Opening of the regulatory procedure for the drafting of an administrative regulation on the fees to be paid to ANACOM for the issue of certificates and the reproduction of documents


It is hereby made public, under the terms and for the purposes of paragraph 1 of article 98 of the Administrative Procedure Code (APC), that the Board of Directors of Autoridade Nacional de Comunicações (ANACOM), in the exercise of the regulatory power provided for in paragraph 2 a) of article 9, in article 10 and in paragraph 1 b) of article 26, all of the respective Statuteshttps://www.anacom.pt/render.jsp?contentId=1351851 approved by Decree-Law No 39/2015, of 16 March, and under the terms of paragraph 3 of article 83 of the APC and paragraphs 1 b) and c) of article 13 and paragraphs 1, 4, 5 and 6 of article 14 of Law No 26/2016https://www.anacom.pt/render.jsp?contentId=1690252 of 22 August (LADA), decided on 7 November 2023 to initiate the procedure for the drafting of an administrative regulation on the fees to be paid to ANACOM for the issue of certificates and the reproduction of documents.

In particular, the purpose of this Regulation is:

a) To determine the objective and subjective incidence, the reductions and exemptions, the value and the rules for the settlement and collection of the fees to be paid to ANACOM for the issue of certificates and the reproduction of documents included in administrative files, as well for the reproduction by photocopy or by any technical means, namely visual, audio or electronic, or for the issue of certificates relating to administrative information not included in the procedure, in accordance with paragraph 1 of article 15  and paragraph 3 of article 83 of the Administrative Procedure Code, and with paragraph 1 b) and c) of article 13 and paragraph 1 of article 14 of the LADA;

b) To set time limits for the issue of certificates and the reproduction of documents included in administrative files or resulting from the right of access to administrative documents, particularly in cases of urgency; and

c) To justify the fees and their updating system from an economic and financial point of view.

Interested parties may, within 10 working days of the publication of this notice, submit to ANACOM, in writing, any contributions they believe should be taken into account in the drafting of this Regulation to regulamento.dgpr@anacom.pt. Contributions may therefore be submitted until 22 November 2023.

At a later date, interested parties will be able to comment on the draft regulation, which will be subject to public consultation in accordance with the provisions of article 10 of the Statutes and article 101 of the APC, through its publication on ANACOM’s institutional website (www.anacom.pt) and in Series II of the Official Gazette.

ANACOM will assess the contributions received from interested parties and, following the adoption of this Regulation, will make available a report containing a reference to all the contributions received and an overall assessment reflecting the Authority’s understanding of them and the reasons for the options chosen.
