ANACOM approves new TMDP Regulation


On 16 January 2024, ANACOM approved the Regulation that sets out the rules and establishes the procedures to be adopted by undertakings that offer public electronic communications networks and publicly available electronic communications services at a fixed location, for the calculation, settlement and payment of the Municipal Fee for Rights of Way (TMDP Regulation).

The TMDP - Taxa Municipal de Direitos de Passagem (Municipal Fee for Rights of Way) is calculated based on a percentage of the total monthly invoicing issued by undertakings that offer publicly available electronic communications networks and services at a fixed location, for all end customers in the corresponding municipality; this percentage, which cannot exceed 0.25%, is set annually by each municipality and must be announced by the end of December in the previous year for which it is intended to come into effect.

This regulation comes into force on the first working day following its publication in Diário da República (Official Journal), notwithstanding the transitional provisions provided for in the Regulation.
