ANACOM approves the draft regulation defining the rules and setting out the procedures for the calculation, settlement and payment of the municipal fee for rights of way (MFRW) to municipalities


On 1 August 2023, ANACOM approved the draft regulation defining the rules and setting out the procedures to be adopted by companies providing public electronic communications networks and publicly available electronic communications services, at a fixed location, for the calculation, settlement and payment of the municipal fee for rights of way to municipalities (MFRW Regulation).

The municipal fee for rights of way (MFRW) is determined by applying a percentage to the total monthly invoice issued by companies providing publicly available electronic communications networks and services at a fixed location to all end users in the municipality concerned; this percentage, which may not exceed 0.25%, is set every year by each municipality by the end of December of the previous year for which it is to apply.

The draft regulation will be published in Series II of the Official Gazette, with a period of 30 working days from that date for contributions to be submitted in writing and in Portuguese, preferably by e-mail to the address regulamento.tmdp@anacom.pt.
