ANACOM approves regulation amending the Regulation on the provision of statistical information


On 4 May 2023, ANACOM approved the regulation amending Regulation no. 255/2017 of 16 May on the provision of statistical information.

Regulation no. 255/2017https://www.anacom.pt/render.jsp?contentId=1415433 on the provision of statistical information, applicable to undertakings providing electronic communication services and networks, was published with the aim of defining a set of information which enables monitoring of the various markets and services and oversight of compliance with provider obligations, the definition of relevant markets and assessment of significant market power, as well as the fulfilment of its other assignments.

Taking into account the development of the electronic communications sector, the market and available technologies that has occurred since the entry into force of the Regulation in 2017, ANACOM considered that it was time to amend it.

The present regulation incorporates statistical information made by ANACOM outside the scope of Regulation no. 255/2017 of 16 May, including: requests for information on offers/tariffs for electronic communications services; requests for information about premium channels ;requests for additional statistical information; and requests for statistical information about 5G retail services.

The structure of the questionnaire was altered, creating separate modules, facilitating identification of the reporting of the various services by providers and, consequently, interaction with providers on this matter.

The regulation aims to adapt the information that is collected to current needs, including requests for information from national and international bodies and requests for information from other EU NRA to which ANACOM is obliged to respond. The regulation also eliminates indicators with low response rates, with a reduced relative weight or associated with services whose development did not correspond to initial expectations or which have reached the end of their life cycle.

Identifying new technological and market realities and consequent unsatisfied information needs, the regulation also adapts existing definitions to current needs and creates new indicators that allow the sector's development to be monitored. In particular, indicators relating to 5G, 4G, video-streaming on demand, contract lock-in periods and subscriber loss and acquisition, indicators on suspension of services due to non-payment and also by customer segment (residential/non-residential) and geographical area.

A set of indicators was also created to allow monitoring of the Social Internet tariff. Likewise, indicators on mobile accesses are included in roaming in, with geographical breakdown by parish, so that information can be shared with INE, aiming to assess the use of spaces and population mobility, as well as the load and pressure on specific areas of the territory.

This regulation enters into force on the day following its publication in Diário da República (Official Journal).
