ANACOM imposes fine on CTT for breach of universal postal service obligations


ANACOM imposed on CTT - Correios de Portugal (CTT) a single fine of around EUR 154 thousand, after it was proven, in administrative offence proceedings, that it did not comply with objectives of postal network density and minimum service offers (in nine cases), that it failed to send quarterly information on objectives of postal network density and minimum service offers (in three cases) and that it failed to advertise in postal establishments updated information on indicators of quality of service and prices in force (in twenty-nine cases).

The behaviour adopted by CTT is detrimental to the right of users of the universal postal service (UPS) to access the services and to post mail, covering, at most, the distance defined for such purpose in the objectives of postal network density and minimum service offers, as well as to have the service effectively available during the time specified in those objectives and, furthermore, to have access to a set of data deemed relevant, in particular prices, which allows them to purchase the services properly  informed and aware of their costs and quality.

Bearing in mind that the provision of reliable information is essential to monitor the activity carried out by the USP provider and to verify compliance with the obligations to which it is legally subject, the behaviour adopted by CTT also seriously undermines the exercise of tasks entrusted to ANACOM.

CTT challenged in court the decision of this Authority, and the respective appeal was referred to Tribunal de Concorrência, Regulação e Supervisão (the Competition, Regulation and Supervision Court) on 3 June 2022.
