Statement of Rectification

Pursuant to the provisions of point h) of paragraph 1 of article 4 and article 11 of Decree-Law no. 4/2012 of 16 January (as amended by Decree-Law no. 41/2013 of 21 March), it is stated that Decree-Law no. 92/2017, published in Diário da República (Official Journal), 1st series, no. 146, of 31 July 2017, was issued with the following inaccuracies which, by statement of the issuer, are hereby rectified:
1 – Where it reads, in point b) of article 8 (Repeal provision):
"b) Paragraph 3 of article 1, point u) of paragraph 1 of article 3, paragraphs 5, 6 and 7 of article 7, point a) of article 17, paragraph 4 of article 31, articles 95, 96, 97, 98, 99 and 104, and paragraph 2 of article 109 of Decree-Law no. 123/2009 of 21 of May (as amended by Decree-Law no. 258/2009 of 25 September, and by Law no. 47/2013 of 19 July and Law no. 82-B/2014 of 31 December)."
it shall read:
"b) Paragraph 3 of article 1, point u) of paragraph 1 of article 3, paragraphs 5, 6 and 7 of article 7, point a) of article 17, paragraph 4 of article 31, point v) of paragraph 3 of article 89, articles 95, 96, 97, 98, 99 and 104, and paragraph 2 of article 109 of Decree-Law no. 123/2009 of 21 of May (as amended by Decree-Law no. 258/2009 of 25 September, and by Law no. 47/2013 of 19 July and Law no. 82-B/2014 of 31 December)."
2 - In annex II - republication of Decree-Law no. 123/2009 of 21 May, paragraph 4 of article 11, which reads:
"4 - ANACOM may, as deemed warranted, issue guidelines applicable to the definition of the technical instructions provided for in the previous paragraph."
it shall read:
"4 - ANACOM may, as deemed warranted, issue guidelines applicable to the definition of the technical instructions provided for in paragraph 2."
