Autoridade Nacional de Comunicações (ANACOM) has concluded 209 cases of breach proceedings in the first six months of this year, with fines applied in 53 cases. In total, ANACOM applied fines of 1.680 million euros in this period.
During the first six months, 244 new cases were instigated with breach proceedings. The majority of cases brought resulted from breaches of legislation governing the provision of electronic communications networks and services and from breaches of the regime governing the construction of telecommunications infrastructure in buildings (ITED). A number of proceedings were also brought in response to violations of the rules applicable to the licensing, supervision and use of the spectrum of radiocommunications networks and stations. The availability on the market of non-compliant radio and terminal equipment also led to the instigation of breach proceedings, along with other proceedings in the postal sector and others which result from breaches of the rules governing audiotext services.
Proceedings brought by ANACOM are based on reports of offences brought to ANACOM's attention by different means, including: market inspections and enforcement actions, spectrum monitoring and control actions performed by ANACOM, action undertaken as part of ANACOM's work supervising and overseeing the electronic communications and postal services market, complaints, accusations of the Public Prosecutor, courts and other regulators, reports and cases of the PSP and GNR.
