Compensation fund and net costs of the universal service of electronic communications - final decision


On 29 January 2015, ANACOM has approved a decision identifying the undertakings required to contribute to the electronic communications universal service compensation fund and setting the value of the extraordinary contributions as regards the CLSU - custos líquidos do serviço universal (net costs of universal service) to be compensated for the 2007-2009 period.

ICP-ANACOM has determined:

  • a review of the turnover values reported by certain companies eligible for purposes of determining the overall turnover of the sector, in particular following audits and analysis conducted by ANACOM;
  • that the overall value of eligible turnover for the sector, for the purposes of Law no. 35/2012 of 23 August, is 4,688,812,675.81 euros;
  • the list of undertakings required to make payment of an extraordinary contribution to the compensation fund, and the value of the contribution of each undertaking, with the total corresponding to the amount of compensation payable to MEO - Serviços de Comunicações e Multimédia (MEO) as the universal service provider with respect to the net costs for the years 2007-2009, as approved by ANACOM on 19 September 2013;
  • that MEO, shall not settle the contribution which it is required to pay, since the amount of compensation to which it is entitled is higher; as such the amount of compensation to which the company is entitled is reduced by the value of the contribution due.

Approval was also given to the report of the prior hearing to which the respective draft decision was submitted, following ANACOM decision of 19 December 2014.
