Decision on the publication of quality of service performance levels for the reference poles access offer

By determination of 11 March 20091, ICP - ANACOM approved a decision on the publication of quality of service performance levels for wholesale offers made available by PT Comunicações, S.A. (PTC) and regulated by that date2.

Subsequently, PTC published on 22 December 2010, a first draft of a new wholesale offer (the Reference Poles Access Offer - RPAO3), further to ICP - ANACOM’s determination of 28 October 2010 on amendments to RCAO, which imposed the creation of that offer.

As such, although RPAO already provided for quality of service parameters and levels (in conformity with ICP - ANACOM’s determination of 28 October 2010), given that this offer was created after ICP - ANACOM’s determination of 11 March 2009, RPAO was not subject to the same publication obligations which govern the remaining wholesale offers, and as such PTC does not regularly provide information on demand and quality of service performance indicators for RPAO.

As these are relevant data required by ICP - ANACOM in order to monitor the market, as well as by RPAO’s customers, it was deemed crucial to extend to RPAO the scope of application of ICP - ANACOM’s determination of 11 March 2009 on the publication of quality of service performance levels for PTC’s wholesale offers.

Therefore, whereas:

(a) ICP - ANACOM approved on 11 March 2009 a decision on the publication of quality of service performance levels for RUO, LLRO, RCAO, “Rede ADSL PT” and SLRO;
(b) Further to the decision of 28 October 2010, PTC published on 22 December 2010 the first draft of RPAO;
(c) Information on demand and quality of service performance indicators for RPAO is crucial for monitoring the market;
(d) ICP - ANACOM’s determination of 11 March 2009 on the publication of quality of service performance levels for wholesale offers defines a set of conditions on how and when information should be provided;
(e) By determination of 9 October 2014,  ICP - ANACOM approved a draft decision (DD) on the publication of quality of service performance levels for RPAO, which was submitted to the prior hearing of interested parties, in accordance with articles 100 and 101 of the Administrative Procedure Code, for a period of 20 working days;
(f) Further to the publication of the DD, interested parties were heard, their positions and ICP - ANACOM’s analysis thereon being included in the respective prior hearing report which is an integral part of this decision,

The Management Board, in the scope of assignments provided for in points b), e), f), h) and n) of paragraph 1 of article 6 of its Statutes, approved by Decree-Law No. 309/2001, of 7 December, in the pursue of competences provided for in points b) and g) of article 9 of the same Statutes, taking into account regulatory objectives provided for in points a) and c) of paragraph 1, point b) of paragraph 2 and point c) of paragraph 5, all of article 5 of Law No. 5/2004, of 10 February, as amended by Law No. 51/2011, of 13 September, and to implement measures determined further to the imposition of obligations in the scope of access to poles owned by PT Comunicações, S.A., hereby determines:

1. Information obligations provided for in ICP - ANACOM’s determination of 11 March 2009 on the publication of quality of service performance levels for wholesale offers shall apply to RPAO.
2. For the purpose of the preceding paragraph, to Appendix 2 to determination of 11 March 2009 is hereby added the information laid down in the annex to this determination.
3. The first information on RPAO shall concern the second quarter of 2015, and shall be published by PT Comunicações, S.A. by the end of July 2015.

  • to ICP-ANACOM, duly broken down individually by all beneficiaries of the offer, by the set of companies of the PT Group, by the set of all OSP and by the set of all beneficiaries of the offer.
  • to beneficiaries of the offer, duly broken down by the beneficiary to whom the is coveyed, by the set of companies of the PT Group, by the set of all other OSP and by the set of all beneficiaries of the offer.
  • to the end-user, duly broken down by the set of companies of the PT Group, by the set of all OSP and by the set of all beneficiaries of the offer.
