New rules to regulate distance contracts


On 13 June 2014, new rules entered into force regulating contracts concluded at a distance and away from business premises. The amendments are aimed at promoting transparency in business practices and will protect the legitimate interests of consumers.

ANACOM has provided a set of questions and answers on its Consumers' Website to explain the new rules which apply to these contracts. Under the new rules, consumers have a legal right to terminate contracts without penalty and without giving a reason; this right may be exercised within the first 14 days after concluding the contract.

Decree-Law no. 24/2014 of 14 February extends the obligations of operators to make clear and comprehensive information available to consumers in a timely manner, so that consumers are able to make properly informed decisions on whether or not to contract services and are aware of their rights and obligations.

By providing information on the new rules, ANACOM will ensure that users are properly informed of their rights when agreeing contracts at a distance.
