Charges related to ITED and ITUR inspection activities (article 88, paragraph 2, Decree-Law no. 123/2009 of 21 May)
With the aim of instilling greater transparency and determinability in the criteria governing the calculation of charges resulting from the conduct of inspections undertaken to verify the obligations established in respect of ITUR - infraestruturas de telecomunicações em loteamentos, urbanizações e conjuntos de edifícios (infrastructures for telecommunications in housing developments, urban settlements and concentrations of buildings) and ITED - infraestruturas de telecomunicações em edifícios (telecommunications infrastructure in buildings), as provided for in article 88, paragraph 2 of Decree-Law no. 123/2009 of 21 May, republished by Decree-Law no. 258/2009 of 21 September, on 22 October 2012, the Management Board of ICP-ANACOM determined:
a) To approve a calculation methodology which includes a value/hour of the technicians involved and the number of standard hours entailed in different types of action, including transportation, on-site inspection and report preparation;
b) To approve the values derived from said methodology:
a. ITED - infrastructure in houses - 351.00 euros;
b. ITED - infrastructure in buildings with two or more dwellings or in special buildings - 495.00 euros;
c. ITUR - 522.00 euros
Project Analysis - 189.00 euros (when deficiencies occur in the project requiring extra analysis activity, reasoning and report preparation).
c) To determine that, when responsibility for non-compliance lies with more than one agent, the value of the charges is to be distributed equally among those whose responsibility has been demonstrated, in accordance with article 88, paragraph 2 of the Decree-Law referenced above.
d) To determine the application of these amounts as values limiting the charges established in inspection processes conducted prior to the approval of the present determination and hereto pending settlement.
