New portability rules come into force


The new rules for portability come into force on 13 September 2012. Portability is the procedure that allows subscribers to change their telephone operator (fixed or mobile), keeping the same number.

The main change concerns the guarantee given to subscribers that the numbers will be fully transferred within no more than one working day of the presentation of the portability request, together with all the required documentation, to the new operator. There are some exceptions to this deadline, where portability must take place within no more than 3 working days, or as soon as possible.

In the event that this deadline is not met, the new provider is bound to compensate the subscriber in the sum of 2.5 euros per number and per day of delay. The compensation is payable by the new provider and shall be paid within 30 days.

These new rules were approved by Regulation 114/2012, of 13 March, approved by ANACOM determination of 1 March 2012, which amended the Portability Regulation (Regulation 58/2005, of 18 August, amended, republished and renumbered by Regulation 87/2009, of 18 February, and amended by Regulation 302/2009, of 16 July).
