Following the legislative authorization granted by Law no. 6/2003 of 6 March, on the compulsory purchase regime for the basic telecommunications network, Decree-Law no. 95/2003 of 3 May was approved, under which the compulsory purchase of the basic telecommunications network, or of any of the assets which integrate it, is permitted, for reasons of public interest, duly justified.
Although such a scenario is not to be expected in the present time, the statutory instrument is now published to meet the possible occurrence of exceptional circumstances where the public interest demands the repurchase of the basic network by the State.
In the event of a compulsory purchase, the value of the compensation shall correspond to the value of the asset to be purchased at the date of the purchase decision, that value being established by a court of arbitration.
