In the scope of the assignments conferred by article 6 of the Statutes in annex to Decree-Law no. 309/2001, in particular the provision of paragraph 1 thereof, namely points b), f) and h), having regard to the regulation aims provided for in points a) and c) of paragraph 1 of article 5 of Law no. 5/2004, and the provisioned in the point b) of paragraph 1 and paragraph 3 of article 27 of the Operation Regulation approved by Decree-Law no. 290-A/99, applicable pursuant to point a) of paragraph 2 of article 122 of Law no. 5/2004, the Board of Directors, at the meeting held on 07.10.2004, in the pursue of the responsibilities conferred thereupon by point l) of article 26 of the Statutes of ICP-ANACOM, has determined:
1. To authorize the request submitted on 21.05.2004 by PT Comunicações, S.A., which is entitled to suspend the leased line service provided to Eastécnica V - Comunicações Globais, S.A.
2. That the Service suspension under the terms requested by PT Comunicações, S.A. is subject to the prior notification of Eastécnica V - Comunicações Globais, S.A., of 20 days at the least, in order to ensure that this undertaking may ensure the compliance with the obligation provided for in point c) of paragraph 1 of article 39 of Law no. 5/2004.
3. That Eastécnica V - Comunicações Globais, S.A., shall ensure the compliance with the obligation provided for in point c) of paragraph 1 of article 39 of Law no. 5/2004 in case of termination of provision of any offered services.
