Information to be gathered to monitor the market in the scope of the LLU


By determination of 7 February 2006, ANACOM granted approval to the decision on information to be gathered to monitor the market in the scope of the local loop unbundling (LLU).

This Authority deems fundamental to be provided with access to up-to-date and detailed information, submitted by operators that take part in the offer, on time limits practised for several services related to the LLU, in order to ensure, where necessary, a swift intervention, to impose remedies and to protect the interests of end-users. This should occur without prejudice to the obligation of PT Comunicações (PTC) to send the quarterly report on the levels of quality of service provided in the scope of the reference unbundling offer (RUO) and on compensations incurred, according to the provisions of the determination dated 8 November 2005.

In this scope, PTC and operators and service providers (OSP) who are beneficiaries of the RUO must submit to ANACOM the relevant information on a monthly basis, and by the end of the month following that to which it corresponds. This information must be submitted from April 2006 onwards, which implies that the information concerning the month of April shall be provided by the end of May 2006.

Interested parties were consulted, and comments received, the respective assessment and grounds are comprised in the prior hearing report on the draft decision of 14 December 2005, which is an integral part of the determination.
