Wholesale naked digital subscriber line (Naked DSL) - public consultation report


By determination of 25 July 2007, ANACOM approved the report on the public consultation concerning the wholesale naked digital subscriber line (Naked DSL), launched following determination of 4 April 2007, which aimed to gather the opinion of different market participants, and thus to contribute towards the decision on the introduction of the wholesale naked digital subscriber line (NDSL).

The consultation attracted a great amount of attention, having been received responses from 56 individual entities, who showed without exception their interest in the NDSL, as well as from the following operators: TV Cabo, Colt, G9SA, PT Group (a joint response from Portugal Telecom SGPS, PT Comunicações, PT.COM - Comunicações Interactivas, PT Prime - Soluções Empresariais de Comunicações e Sistemas, PT Wi-Fi and TMN), SGC Telecom (on behalf of AR Telecom and WTS), Sonaecom (on behalf of Novis Telecom and Optimus), Nortenet, OniTelecom,Tele2 and Vodafone.

ANACOM deems the NDSL to be an important contribution towards the promotion of penetration of broadband services and competition, namely in the least populated regions and in areas with least favoured populations, by contributing towards the reduction of total costs borne by end users in the scope of broadband Internet access.

In the light of the above, and taking into account the results of the consultation and the fact that the NDSL is already available in around two thirds of other EU countries (15), either by regulatory imposition, or at the initiative of the incumbent operator, ANACOM considers that a period of time should be granted to enable the market's own operation, so that PT Comunicações (PTC), in collaboration with entities interested in the process, without any regulatory intervention necessary, implements an offer with these features, which is likely to contribute significantly towards the development of the information society.

Within this context, it is recommended that PTC amends, up to 31 October 2007, the ''PT ADSL Network''offer, so as to include the NDSL, in both modalities (ATM and IP aggregation), and applicable to active and non-active loops, having heard beneficiaries of the offer for 15 working days at the least, and taking into account the view taken by ANACOM in the present report, namely in terms of applicable prices and deadlines for supply and return of the service.

Moreover, it is also recommended that PTC defines an implementation schedule of its offer, so that the NDSL is operational as from 1 February 2008.

Lastly, PTC is required to make the relevant developments known to ANACOM, including the ''PT ADSL Network'' offer altered by 31 October 2007 and the offer implementation schedule, this Authority being entitled to act where the implementation schedule or the features of the offer are not deemed appropriate or compatible with the regulatory principles in force.
