Guidelines for minimum content to be included in electronic communication contracts - consultation on amendments


ANACOM  gave approval, on 4 June 2008, to the launch of a public consultation on the draft decision on the amendment to the Guidelines for minimum content to be included in contracts for the provision of electronic communication services with respect to ''loyalty periods''.

Interested parties should send their comments no later than 11 July 2008, in writing to the head office of this Authority or electronically to  cm_contratos@anacom.pt. In the publication of the results, comments which have been expressly marked by respondents as being confidential will be withheld.

Approval was likewise given to the draft decision on the amendment of the same Guidelines for minimum content in these contracts following the entry into force of Law no 12/2008 of 26 February. Under the terms of this draft decision, all providers of electronic communication services shall adapt their respective subscription contracts to the new regime that is to be approved and send subscribers a communication with information on the contractual alterations to be made as a result of this Law. This measure is submitted to a prior hearing of interested parties under the terms of article 100 and subsequent articles of the Code of Administrative Procedure, with a period of 20 working having been set during which interested parties may respond in writing.

The objective of this determination is to ensure compliance with the obligation set forth by Law no 12/2008 of 26 February, which amended the Law of Essential Public Services (Law no 23/96 of 26 July), as well as to guarantee that the contracts for the provision of electronic communication services contain clauses which regulate, clearly and unequivocally, so called ''loyalty periods''.
