Wholesale markets for voice call termination in individual mobile networks (market 16)


ANACOM approved in a determination dated 25 February two decisions concerning the wholesale markets for voice call termination in individual mobile networks (market 16 of Commission Recommendation 2003/311/EC of 11 February 2003): one on the definition and analysis of competition, assessment of significant market power (SMP), and the imposition, maintenance, amendment or withdrawal of regulatory obligations; and the other on the price control obligation.

ANACOM concluded that three relevant markets exist in Portugal – the wholesale market for voice call termination in the TMN mobile network, the wholesale market for voice call termination in the Vodafone mobile network and the wholesale market for voice call termination in the Optimus mobile network – and that the three mobile network operators have SMP in the supply of voice call termination services in the respective networks.

These operators are subject to the following obligations: to respond to reasonable access requests; non-discrimination in the offer of access and interconnection and in the respective provision of information; transparency in the publication of information; price control (orientation to costs) and cost accounting; and accounts separation.

Adoption of the established measures was preceded by the applicable consultation procedures, in wake of the determination dated 21 December 2004. The corresponding report has now also been approved; it examines the comments received, from the following entities: Grupo PT; Vodafone Portugal, Comunicações Pessoais, S.A. (Vodafone); Optimus Telecomunicações, S.A., (Optimus); OniTelecom – Infocomunicações, S.A. (ONI); Telemilénio – Comunicações, S.A. (Tele2); SGC Telecom, S.A. (SGC); and BT Portugal – Telecomunicações, Unipessoal, Lda. (BT Portugal). The opinion of the Competition Authority was also obtained and the European Commission issued the respective comments.

The measures now adopted will be notified, within the legal time periods, to the European Commission and to the national regulatory authorities (NRAs) of the other member States.
