Markets of voice call termination on individual mobile networks and obligation to control prices (drafts)

By determination of 14 January 2010, ANACOM has approved the draft decisions on the definition of relevant wholesale markets for voice call termination on individual mobile networks, the assessment of SMP in these markets and the imposition, maintenance, amendment or withdrawal of regulatory obligations, as well as the details of the implementation of the obligation to control prices.

These drafts are subject to the general consultation procedure as set out in Article 8 of the Law of Electronic Communications (Law No 5/2004 of 10 February), as well as to the procedure of prior hearing of interested parties, under the terms established by Articles 100 and 101 of the Code of Administrative Procedure, whereby a period of 20 working days is provided for comments in the context of processes.

The draft decisions were also referred to Autoridade da Concorrência (the Competition Authority) for an opinion, in accordance with applicable law.

Subsequent to the national public hearing process, notification will be made to the European Commission and to the national regulatory authorities of other Member States.
