17.5. Oversight of models of disclosure of information on quality of service in Internet service provider (ISP) subscription contracts


In light of the new ECL, ICP-ANACOM commenced the systematization of information contained in subscription contracts filed with it, in respect of the following aspects:

  • Minimum levels of quality of services offered, including the time required for the initial connection;
     
  • Compensation and reimbursements payable where contracted levels of quality are not accomplished;
     
  • Restrictions imposed on the use of supplied terminal equipment, any limitations on access and use of services, as well as measures to manage traffic so as to avoid exhausting or exceeding contracted capacity, indicating, in this case, how such procedures could impact quality of service;
     
  • Other information related to quality of service.

This activity coincided with a period that saw a large number of providers file new contracts with ICP-ANACOM, with several companies making successive changes to previous contracts, in particular to adapt them to the new ECL, this work therefore continues in 2013.

In October 2012, the questionnaire on quality of service was reissued via the BEREC contact network, in order to update the benchmark performed in November 2011, based on the summary of responses received. In addition to again questioning NRA on measures implemented in this area (including stipulation by the regulator as to the quality of service information to be included in contracts), the opportunity was taken to obtain information on any decisions, published legislation or documents prepared by each NRA following developments, occurring in the meantime, in the context of the following BEREC documents: ''A framework for Quality of Service in the scope of Net Neutrality'' and ''BEREC Guidelines on Transparency in the scope of Net Neutrality''.

This Benchmarking was completed on 5 December 2012.
