17.2. Monitoring of obligations established pursuant to rights of use of frequencies granted for provision of the terrestrial electronic communications services


Subsequent to the multi-band auction and allocation of new rights of use of frequencies to Optimus, TMN and Vodafone, as well as the unification of titles, these operators were ordered to send information which enabled ICP-ANACOM to monitor the obligations established under said titles. In this context, in 2012, the providers were required to report:

(i)    Information on accomplished coverage;

(ii)   Information on quality of service parameters;

(iii)  Models of implementing the site-sharing policy on the Internet.

These elements are used to monitor the implementation of site-sharing models on the Internet and the fulfilment of coverage and quality of service obligations associated with the rights of use of frequencies granted prior to the multi-band auction. Coverage obligations attached to rights of use of frequencies allocated subsequent to the multi-band auction are still to be defined in detail, in accordance with article 34 of the Auction Regulation.

The information on coverage, quality service and implementation of site-sharing reported at the end of 2012 was submitted to ICP-ANACOM within the stipulated deadline (20 January 2013), and is currently being reviewed.

In the context of monitoring compliance with the coverage, quality of service site-sharing obligations (with reference to the end of 2011), as established pursuant to rights of frequency of use (for provision of the land mobile service - Global Positioning System - GSM and UMTS) previously in force, at the beginning of 2012, operators sent ICP-ANACOM the information specified in its determination of 17 November 2011.
