Under the terms of articles 28 and 29 of the Auction Regulation, on 15 December 2011, the Management Board of ICP-ANACOM approved the following drafts:
a) Draft Report of the auction;
b) Draft decision to grant rights of use of frequencies.
In accordance with article 28 of the Auction Regulation, ICP-ANACOM notified all bidders that, if they saw fit, they should state positions in writing, within a period of ten working days following the date of reception of the notification, namely: OPTIMUS TMN, VODAFONE and ZON III.
Positions were received on a timely basis from OPTIMUS, VODAFONE and TMN, whereas TMN sent a request to rectify its stated position, which request was received subsequent to the expiry of the deadline.
Based on this prior hearing procedure, the respective Report was drawn up (Annex 64) which, based on the positions received, presents the position taken by ICP-ANACOM and is an integral part of the present final report, giving basis to the decision allocating rights of use of frequencies.
