Administrative Rule


Decree-Law no. 309/2001, of 7 of December approved the new statues of the ICP - Autoridade Nacional de Comunicações (ICP-ANACOM), the entity empowered to apply and supervise the enforcement of laws, regulations and technical requirements which fall within the scope of its responsibilities, as well as communications operators compliance with the provisions of the respective licences for the exercise of activity or concession contracts.

Considering that the supervisory powers must be exercised by fully safeguarding the rights and guarantees of citizens, without adversely affecting the efficacy of the supervisory activities, the employees of ICP-ANACOM, respective attorneys and the qualified and duly accredited people or entities who perform oversight functions, when exercising their function are considered to be agents of authority.

The aforementioned persons or entities must, under the terms of the law, carry with them identification cards evidencing their functions, in such a format and on such conditions as contained in the respective order from the member responsible for communications.

Therefore:

In accordance with Article 48, no. 2 of the statues of ICP-ANACOM, published in the annex to Decree-Law no. 309/2001 of 7 of December, the Government hereby decrees, through its Minister for Social Equipment, the following:

1. The format of the identification card for the exclusive use of the employees of ICP - ANACOM respective attorneys and the qualified and duly accredited people or entities who perform oversight functions, under the terms of the law, is hereby approved and is contained in the annex to the present administrative rules, of which it forms an integral part.

2. The identification cards shall be signed by the president of the chairman of the board of administration of ICP-ANACOM and authenticated with its embossed seal.

3. The identification cards shall be valid for the period mentioned therein

4. The cardholders must return the cards:

a. On expiry;

b. On termination of employment or of their supervisory functions at ICP-ANACOM or when their mandate or accreditation comes to an end;

c. In any event, whenever the administration board of ICP-ANACOM shall so determine.

5. Without prejudice to the provision of the preceding paragraph, in case of alteration to any of the particulars contained in the card, the cardholder must return the card to ICP-ANACOM for substitution.

6. In case of loss, destruction or deterioration of the card and on obtaining from the cardholder to that effect, a duplicate card shall be issued with express indication of that fact on the card itself, which will bear the same number.

7. The present administrative rule shall come into force on the day following the date of its publication.
