Universal service compensation fund - determination of the value of contributions relating to the net costs of the universal service of electronic communications (2014 and 2016)


On 26 January 2018, ANACOM approved a decision identifying the undertakings required to contribute to the electronic communications universal service compensation fund and setting the value of the contributions relating to the net costs of universal service (NCUS) to be given compensation for the period 2014 (NCUS approved in 2016) and 2016 (period subsequent to designation of the universal service providers by tender).

In accordance with LCE - Lei das Comunicações Eletrónicas (Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=975162) and Lei do Fundo (Fund Lawhttps://www.anacom.pt/render.jsp?contentId=1136652), ANACOM specifically determines the following:

  • Correction of the values of eligible turnover reported by some companies for the purposes of calculating overall sector turnover, including as a result of auditing and analysis conducted by ANACOM.
  • Overall sector turnover in respect of 2016 with a value of 4,347,035,580.62 euros.
  • The list of undertakings required to make payment of an extraordinary contribution to the compensation fund and the payment of contributions to the net costs incurred by the universal service providers designated by public tender.
  • The value of the contribution of each undertaking for the following purposes:

- compensation of NCUS in respect of 2016, as incurred by provision of NOS Comunicações, under the contracts concluded with the Portuguese State for the universal service provision of connection to a public communications network at a fixed location and publicly available telephone services.

- compensation of NCUS in respect of 2016, as incurred by provision of MEO - Serviços de Comunicações e Multimédia (MEO), under contracts concluded with the Portuguese State for the universal service provision of public pay-telephones.

- compensation of NCUS in respect of 2016, as incurred by provision of MEO, under contracts concluded with the Portuguese State for the universal service provision of a comprehensive telephone directory and a comprehensive directory enquiry service.

- compensation for the NCUS for 2014 (approved in 2016), as incurred by provision of MEO as universal service provider in the period prior to designation by tender.

  • Specification of period of 20 working days, following notification of the final decision, for payment of the contributions identified in the preceding paragraph.
  • That MEO, shall not remit the contribution which it is required to pay in respect of NCUS 2014 (approved in 2016), since this contribution is exceeded by the amount of compensation to which it is entitled; as such the amount of compensation to which the company is entitled is reduced by the value of the contribution.

Approval was also given to the report on the prior hearing to which the respective draft decisionhttps://www.anacom.pt/render.jsp?contentId=1425569 was submitted - approved on 14 December 2017.
