ANACOM’s determination of 23 February 2006 approved the recovery and reconfiguration of the rights of use of FWA frequencies, after requesting those companies to be given additional technical elements, fulfilling the determination of 1 September 2005. The granting of these rights only includes the spectrum currently allocated, in view of its maintenance, and additional spectrum requests will not be taken into account.
The analysis of the proposals received from the FWA operators Novis Telecom, ONITELECOM, PT Comunicações, SGC TELECOM (on behalf of AR Telecom and WTS) and Vodafone – and ANACOM’s understanding of this matter are in the report that is part of this determination.
The draft titles were subject to previous hearing of the interested parties, under the terms and for the purposes stated in articles 100 and 101 of the Administrative Procedure Code (Código do Procedimento Administrativo), and a 20 working day period was set for this consultation.
The settlement and collection of the fees regarding 2004, 2005 and 2006 was also determined, further to the title’s issue. Each operator will be subject to the fees corresponding to the geographical zones for which it holds rights of frequency use, in compliance with Administrative Rule no. 1062/2004 of 25 August (considering the modification of the values on the tables attached to no. 5, in accordance with Administrative Rule no. 126-A/2005 of 31 January).
This concludes Phase I, mentioned in the action plan foreseen in determination of 1 September 2005. Considering the recovered spectrum, available for new allocations, and the interest brought to ANACOM’s attention regarding that same spectrum, besides the possible interest of other entities, this Authority decided to initiate Phase II, by submitting the 24.5 GHz - 26.5GHz frequency band to the full accessibility regime.
For this purpose, it determined the modification of the National Frequency Allocation Plan (NFAP) regarding frequency bands reserved for FWA operation in the 24.5 GHz - 26.5 GHz band, and their allocation process. The granting of the rights of frequency use in the 24.5 -26.5 GHz band, identified as such on the NFAP, should thus be made in accordance with the full accessibility regime, depending on the presentation of the several elements.
