Dismissal of the ownership of the basic network in favor of PT Comunicações

The Resolution of the Council of Ministers n. º 147/2002, approved on 11 December 2002, was published on 26 December 2002,  in the Diário da República n.º 298 (I-B Series).

This Resolution concerns the dismissal of the ownership of the basic network in favor of PT Comunicações and the fact that this company was designated as the provider of the telecommunications universal service, which the basic network supports.

Thus the minutes of the corresponding purchase contract and of the amending agreement of the concession contract of the telecommunications public service were approved by the Council of Ministers, and likewise were delegated the powers for their signature.

Previously, the Assembly of the Republic had approved the first amendment to Law n.º 91/97 of 1 August, which sets out the general basis for the establishment, management and operation of telecommunication networks and the provision of telecommunications services.

This amendment, laid down in Law n. º 29/2002 of 6 December, deassigns from public domain the telecommunications basic network, the concept of which was clarified to represent an asset belonging to the private state domain and which may therefore be disposed of in favor of the provider of the universal service through a direct agreement procedure.
