Addition of new codes, ''761'' and ''762'' to NNP

Characteristics of the codes ''761'' and ''762'' of the National Numbering plan for the provision of Flat-Rate per call services and the definition of specific conditions for the granting of rights to use the numbers of such codes

1. The flat-rate per call service provides a means of accessing goods, services or content, payment for which is made by means of a telephone call, the tariff for which telephone call is defined by the code of access to the service. The characterisation of such services consists of the following:

a. Flat-rate services permit that access is always made in same way, through the application of a set price per call, from any point in the country, to a determined number corresponding to the codes of access to such service;

b. The tariff ceilings applicable are independent of the duration of the call and of the time that it is made, the retail price of which call shall be dependent on the code of access to the service in accordance with the following:

  • 761 - a maximum of €1 per call (excluding VAT);
  • 762 - a maximum of €2 per call (excluding VAT);

2. The rights to use these numbers shall be granted in accordance with the following conditions:

a. The grantee shall be an undertaking offering electronic communication services to the public in accordance with the provisions of Law no. 5/2004 of 10 February;

b. Rights shall be granted in blocks of 10,000 numbers, chosen by the grantee, with the indicated codes;

c. Such numbers shall be composed of three fields, which fields shall identify, from left to right, the type of service, the provider of the flat-rate service and the client (the supplier of the goods or service), in the following way:

3. Such undertaking as are granted rights to use these numbers shall be bound by the following conditions:

a. to comply with the designation and characteristics of the service as set out in paragraph 1, including the tariff ceilings of €1 excluding VAT for the “761” code and of €2 excluding VAT for the “762” code;

b. to ensure that wherever such numbers are divulged, clear information is provided as to the respective price and as to any further conditions applicable to their use;

c. to present quarterly statistical information, no later than the end of the month following the end of each quarter, which information shall be divided by code of service and consist of:

- Number of distinct CLIs distributed by the total number of calls, per month and per CLI, presented in intervals of 10 calls up to 60 calls and more than 60 calls (see example below):

d. perform the portability of the number where such is requested by the client in accordance with Regulation no. 58/2005 of 18 August;

e. comply with all further generic obligations associated with the rights to use numbers, in particular, the effective and efficient use of numbers and the payment of fees, in respective accordance with point b) of paragraph 2 of article 17 and with article 105, both of Law no. 5/2004 of 10 February.

4. Furthermore, the conditions of interconnection as set out by Law no. 5/2004, shall also be applicable, in particular the conditions set out in the RIO for services that are non-geographic and are not free for the caller.
