By determination of 21 December 2004, a draft decision was approved, which regards the definition of product markets and geographic markets, assessment of SMP and the imposition, maintenance, amendment or withdraw of regulatory obligations in the wholesale market of voice call termination on individual mobile networks (market 16 of the Commission Recommendation 2003/311/EC, of 11 February 2003) and likewise the launching of the corresponding general consultation procedure, which was set a 30-working-day-time limit, was approved.
In the scope of the regulatory obligations in the wholesale markets of voice call termination on individual mobile networks, the draft decision on the imposition of price control in such markets and the launching of the corresponding general consultation procedure, which was set an identical time limit, was also approved.
Pursuant to articles 100 and 101 of the Code of Administrative Procedure, the hearing of the interested parties (TMN, Vodafone and Optimus, the providers of publicly available electronic communications services at a fixed location and the operators of public electronic communications networks) was promoted, and for this purpose the same 30-working-day- time-limit was set.
Observations of interested parties shall be submitted in writing to ANACOM, preferably by email, to the address terminacao.movel@anacom.pt.
These draft decisions have been also submitted to the opinion of the Competition Authority, pursuant to article 61 of Law no. 5/2004 of 10 February. ANACOM has decided also to submit the draft decision concerning the definition of product markets and geographic markets, assessment of SMP and the imposition, maintenance, amendment or withdraw of regulatory obligations in the wholesale markets of voice call termination on individual mobile networks, to the specific consultation procedure provided for in article 57 of that Law, with the consequent notification to the European Commission and the national regulatory authorities (NRA) of the remaining Member States.
