Renewal of the rights of frequency use granted to SIC - Sociedade Independente de Comunicação, S.A. and TVI - Televisão Independente, S.A.
ICP-ANACOM's Board of Directors determined, on 17 February 2006, to approve the consultation document concerning the renewal of the rights of frequency use granted to SIC and TVI for the activity of analogue television broadcasting.
This consultation questioned interested parties about ICP-ANACOM’s intention to recover the rights of frequency use granted to SIC - Sociedade Independente de Comunicação, S.A. (SIC) and TVI - Televisão Independente, S.A. (TVI) on the date which, under the legal terms and the corresponding change to the National Frequency Allocation Plan, would be established for the switch-off of television broadcasting using the analogue system.
Comments were received from SIC, TVI and VODAFONE PORTUGAL – Comunicações Pessoais, S.A.
Further to analysing the answers and making the corresponding consultation report, the Board of Directors determined the following, under the joint provisions of paragraph b) of no. 1 of article 16 and of articles 30 and 36 of Law no. 5/2004 of 10 February, of paragraph l) of article 26 and of nos. 1 and 2 of article 27, both from the statutes approved in annex to Decree-law no. 309/2001of 7 December:
1. To approve the final report on the general consultation procedure, under the terms and on the grounds stated therein;
2. To renew, under the terms of article 36 of Law no. 5/2005 of 10 February, the right of frequency use held by SIC and TVI, for a 15 year period, for the activity of television broadcasting using the analogue system;
3. To include among the conditions of renewal of the rights of frequency use stated on the titles to issue the recovery of those frequencies by ANACOM and free of charge, following any changes to the National Frequency Allocation Plan (NFAP), especially further to the setting, under the law, of the date for the switch-off of television broadcasting using the analogue system;
4. To submit the draft versions of the titles of renewal of the rights of frequency use to previous hearing by SIC, TVI and PTC, under the terms and for the purposes stated in articles 100 and 101 of the Administrative Procedure Code, setting a 20 working days period for those companies to send their comments.
