Number portability - ANACOM initiates legal proceedings against PT Comunicações

The Autoridade Nacional de Comunicações (ANACOM) has initiated two countermanding legal proceedings against PT Comunicações, following evidence of breach of number portability rules. These legal proceedings arise in the wake of complaints presented by Cabovisão and Onitelecom, that claim infringement of their rights by the historic operator. As a result of these complaints, the regulator investigated the issue and concluded that evidence existed that PT Comunicações stood in breach of legal requirements.

The situations that were denounced concern alleged failure by PT Comunicações to comply with deadlines specified within the framework of telephone number portability.

In the event of confirmation of the evidence found, PT Comunicações will be subject to fines varying between 12,469.95 Euros and 44,891.81 Euros, for each of the countermanding proceedings, as a result of breach of the terms of Decree Law no. 474/99, of December 8, and Decree Law no. 40/95, of February 15.

Number portability between operators is a function of telecommunications networks whereby a user may change operator while maintaining the same telephone number. This function entered into force on June 30, 2001 for fixed networks and on January 1, 2002 for mobile networks.
