ANACOM considers it appropriate to make spectrum available for terrestrial electronic communications services and will therefore seek the opinion of the market on its interest in the provision of harmonised bands, alone or in combination, and on the allocation procedure and conditions to be adopted, as well as the conditions of use.
The aim of this market consultation is to find the optimal allocation of the available spectrum with a view to its efficient use, to the benefit of competition, innovation and efficiency in the markets that include this type of service, bearing in mind that this is a finite and scarce resource - the radio spectrum - which is an indispensable input for the production and provision of mobile communications services based on a proprietary network.
Six years later, ANACOM is once again consulting on a wide range of frequency bands, including some that have been the subject of previous consultations, and others where the titles authorising their use for terrestrial electronic communications services are expiring or where they could be made available for this type of service for the first time in the short or medium term, namely 700 MHz, 800 MHz, 900 MHz, 1500 MHz, 1800 MHz, 2.6 GHz, 26 GHz and 42 GHz.
It should be noted that on 7 March 2018, ANACOM launched a broad public consultationhttps://www.anacom.pt/render.jsp?contentId=1431846 on the provision of spectrum in the 700 MHz band and other relevant bands: 450 MHz, 900 MHz, 1500 MHz, 1800 MHz, 2.1 GHz, 2.6 GHz, 3.6 GHz and 26 GHz. The aim of this consultation was to obtain the views of the various market players (manufacturers, operators, private and public bodies, users and others) on the provision of this spectrum, with a view to the procedure for the allocation of rights of use for frequencies in the 700 MHz, 900 MHz, 1800 MHz, 2.1 GHz, 2.6 GHz and 3.6 GHz bands.
In addition, a specific public consultationhttps://www.anacom.pt/render.jsp?contentId=1726689 on the 26 GHz band was launched at the end of 2021, the results of which were published in July 2022; a public consultationhttps://www.anacom.pt/render.jsp?contentId=1724923 on the availability of the 1500 MHz band was launched in June 2022, the results of which were published in September 2022; and a consultationhttps://www.anacom.pt/render.jsp?contentId=1737143 on the 700 MHz band (duplex gap and guard bands) was launched in December 2022, the results of which were published in March 2023.
ANACOM has set a deadline of up to 30 working days from the launch of this consultation for interested parties to comment, so contributions can be sent until 25 October 2024, in writing, in Portuguese, preferably by e-mail to atribuicao.espectro.scet@anacom.pt, without prejudice to the possibility of delivering or sending them to ANACOM’s headquarters at 51, Rua Ramalho Ortigão, in Lisbon.
