ANACOM approves draft regulation amending the Regulation on the designation of the "49" range of the National Numbering Plan


By decision of 26 July 2024, ANACOM approved the draft regulation amending Regulation No 532/2023https://www.anacom.pt/render.jsp?contentId=1772463, of 16 May, on the designation of the “49” range of the National Numbering Plan (NNP).

The purpose of this draft Regulation is to:

  • Revise the time limit laid down in paragraph 2 of article 5 of Regulation No 532/2023, of 16 May, which provides that «[c]ompanies providing services identified in article 1 of the Regulation adopted in the annex using NNP numbers shall assign numbers exclusively in the range “49” within the framework of such offers as from the date of commencement of their secondary assignment, by themselves or by a beneficiary to whom they have sub-assigned such numbers, and in any case within 18 months of the entry into force of this Regulation».
  • Provide for a phasing-out period to allow the coexistence of secondary assignment of numbers in the “9x” and “49” ranges for the provision of the services covered by the Regulation, to ensure the disposal of SIM cards made available/supplied by operators to points of sale and to minimise the waste and environmental impact of the destruction of SIM cards in the various sales channels.

After examining the contributions received at the start of the regulatory procedurehttps://www.anacom.pt/render.jsp?contentId=1788657, which was approved on 29 May 2024, ANACOM considers that there are sufficient grounds to:

  • extend the deadline provided for in paragraph 2 of article 5 of the aforementioned regulation by 10 months;
  • and, after this deadline, to provide for a phasing-out period of 4 months to allow the disposal of SIM cards already produced and distributed by the companies’ commercial networks for the provision of the mobile Internet access service (MBB).

This draft regulation, which is now available, will be published in Series II of the Official Gazette and, from that date, there will be a period of 30 working days for contributions to be submitted in writing and in Portuguese, preferably by e-mail to regulamento.m2m@anacom.pt.
